MINUTES of Planning Committee Meeting. 17 February 2010

 
Church Hall 7:00pm
Present: Mr Field (Chairman), Mrs C Ranjbar, Mrs T Tull, Mrs E Smart, Mrs D Kennedy, Mr A Harland,
and Mr A Malir.
Clerk (Mr J Paul) and two members of the public.
 
1 Apology for absence. Received from Mrs Pound and Mr Bond.
 
2. Minutes of the planning meeting held 3 February 2010. Before asking for approval Mr Field requested discussion of 5.1 (SI/10/00086/FUL. 86 Fletchers Lane) as the agent for the applicants considered the PC response to CDC was more negative than he observed as the conclusion at the meeting; the response containing having contained all of the items raised rather than the final statement. A message from Mrs Pound stated she considered not all of the stated objections were discussed. Mrs Pound’s opinion was refuted by the Councillors present. Mr Harland proposed that the minutes should be signed as a correct record, Mrs Ranjbar seconded and all Councillors agreed.  

3. Matters arising from the above minutes. As item 2, Councillors agreed with the response letter.
 
4. Declarations by Councillors of personal interests. None.

5. New Applications for discussion.

5.1        SI/09/05157/FUL. Marsh Farm, Church Farm Lane. Erection of agricultural building to house dry stock – variation of existing permission SI/09/03041/FUL.
PC conclusion – no objection. 
5.2       SI/10/00013/DOM 24 Chalk Lane, Sidlesham. First floor front and rear extensions.
PC conclusion – no objection.
5.3       SI/10/00202/FUL. Three Oaks Nursery, Selsey Road. Siting of mobile home for agricultural worker for temporary period of three years.
PC conclusion – no objection.
5.4      SI/10/00227/ELD. Green Lane Piggeries, Ham Road. Use of land for stationing of caravan for the purposes of residential accommodation.
PC conclusion – object.
The Council considered that the stationing of the caravan and the residential use should not be decided under the ‘4 year rule’ as such use had been clandestine and deliberately in breach of planning communications from Chichester District Council. 
Although there were declarations of residential use; the similarly worded letters were from the applicant’s immediate acquaintances with close knowledge of the site. To the general parish such use was hidden and withheld from the District Council. In 2007 application was made to alter another of the buildings into a residence. On the site map submitted for that application SI/07/05409/FUL the position of a caravan was not drawn although it was now stated to have been present and subsequently replaced with another.
The Parish Council objected to use of the land for residential purposes as it is not in a Settlement Policy Area, also it is in a position considered by the Environment Agency to be at risk of flooding. The accommodation was not required for agricultural purposes.
5.5      SI/10/00229/ELD. Green Lane Piggeries, Ham Road. Use of building as a dwelling house, or for residential purposes
PC conclusion – object

5.6      SI/10/00406/DOM 4 Street End, Selsey Road. Demolition of single storey side extension and erect two storey side extension, rear dormers and front porch.
PC conclusion – no objection.
5.7    SI/10/00254/DOM. Church House, Church Farm Lane. Outdoor sunken swimming pool.
PC conclusion – object.
By a vote of 5 against, 1 for and 1 abstention the Councillors objected to the construction for the following reasons: -
• The area is particularly sensitive immediately adjacent to Sidlesham Parish Church.
• The pool site is too close to the boundary and south door of the church. Noise and activities, normal for a swimming pool, could be intrusive and detrimental to the use of the church and burial ground. 
The Councillors considered that should permission be granted screening and acoustic barriers should be conditions stipulated by CDC Planning Department.

 6. CDC Decisions since last PC planning meeting.
 6.1 SI/09/05113/COU. St Mary’s Church Church Lane. Change of use from agricultural land to graveyard to allow extension to existing churchyard area PERMIT.
6.2   SI/09/04953/TPA. St Mary’s Church, Church Lane. Lateral prune 1m off roof (fading into high canopy on 1 no. Yew tree (T21) (marked on plan as T2) subject to SI/76/00936/TPO. PERMIT
6.3 SI/09/05073/TCA. St Mary’s Church, Church Lane. Notification of intention to crown reduce by 1-1.5m, crown thin by 10% and deadwood 1 no. Crab Apple (T1).  Prune off roof line on 1 no. Ash tree (T3). NOT TO PREPARE A TREE PRESERVATION ORDER

7 Planning Correspondence
7.1 Salliota Business Park. Condition 20 of planning permission SI/05/01644/FUL – lighting, a breach of planning control identified by Enforcement CDC…must apply or comply.

8 AOB
8.1 Mrs Smart reported that a closed meeting was proposed for representatives of the Parish Council to meet and discuss the RSPB plans for Pagham Harbour with Mark Underhill on 5 March.
