Parish Council conclusion no objection but the response to request that if permission is granted the District Council should impose a condition that the change of use is only for the current business and Company; that if the Company ceases trading, changes its type of business or moves away from the premises the permitted use reverts to that granted previously for SI/04/02288/FUL.</p>

Parish Council conclusion no objection to the proposed amendments but the response to request that before a decision is made, the District Council confirms on site that the conditions of application SI/02/01957/FUL have been implemented.</p>

6.1 SI/10/00793/FUL Land South Of Units A To D Jury Lane.   Erection 19m x 6.7m block work building. For the manufacture of small water craft and repairs of GRP boats. PERMIT</p>
<p>6.2 SI/10/01006/TPA Chalk Lane. Various tree works, including reducing, removing branches/stems/stubs, epicormic growth, crown lifting up to 5m (above ground level), reduce sectors (mainly over road up to 4m) cut back tips, cut back from power lines and remove damaged branches on 20 no. Poplar trees (T1 &#8211; T3, T6 &#8211; T11, T13 &#8211; T16, T19, T21, T24, T25, T40, T48 and T49) and 28 no. Poplar trees and 1 no. Hawthorn tree within Groups &#8211; G1 (x 6), G2 (x 3), G4 (x 1), G5 (x 3), G6 (x 5), G7 (x 4), G9 (x 5) and G10 (x 1) (Hawthorn tree).  Fell 5 no. <p>6.3 SYSI/09/03084/FUL Pagham Harbour To Selsey Road Selsey.  A shared surface path for walkers and cyclists from Pagham Harbour to Selsey Manor Road Roundabout. OS Landranger references SZ85609630 to SZ86059435 Timber construction boardwalk to be used to provide access across pumping station frontage and timber access bridge to be provided across one ditch. Full specifications to be supplied prior to construction. WITHDRAWN     </p>
<p>7 General Planning Matters.<br />
7.1 Mobile Home Camp, Jury Lane. A response was received by the Clerk from CDC Social Housing stating that contrary to the rumour, they were not locating people from the social housing list at this site. An additional complaint from parishioners was tabled that due to possible over occupation of the mobile homes (possibly by migrant workers) human sewage was contaminating the ditches adjacent to the area. The Clerk agreed to contact CDC Enforcement Team and Environmental Health, also the Environment Agency requesting investigation of the situation. <br />
 <br />
7.2 Parish Council policy on responses made to CDC relating to planning applications. The Chairman reported a complaint made to him about the School House development application that the PC Planning Committee did not take sufficient notice of objection letters received by CDC and posted on their website. Mr Field had explained to the complainant that he understood the duty of the PC was to evaluate applications as a consultee and produce a response considering the impact and benefit to the whole of the parish. The objection letters sent to CDC were for the District Council consideration; any letters or messages sent to the PC were tabled and assessed by the PC Planning Committee. The Councillors discussed the complaint and decided that the current practice should not be changed, also that the way School House was dealt with was correct.</p>
<p>8 Planning Correspondence. Mattress Recycling, The Forge, Lockgate Road. The Clerk received notice from CDC that the issue of waste is enforced by the Environment Agency and the business has a registered exemption.</p>
<p>9 Items of Urgent Public Importance or Information relating to Planning Matters for referral to the next meeting when a decision is required.<br />
9.1 Medmerry Stakeholders Advisory Group (MStAG). Mr Field reported that a planning application is expected to be lodged at the end of July. Prior to that exhibitions indicating paths, bridle ways etc but not all car parks will be held in the local parishes; in Sidlesham an exhibition will be held on Friday 9th July from 3pm to 8pm in the Church Hall</p>

<p>5. New Applications<br />
5.1 SI/10/00852/FUL. School House, Keynor Lane. Provision of 5 affordable (non-market) residential units on the Sidlesham School campus with 2 of these units provided by the adaptation of the existing school house. O.S. Grid Ref. 484655/97778<br />
 This application generated heated interest from people mainly recently associated with the School, a large sign was erected on the highway in Highleigh Road and pickets were present at the school gates on days previous to the planning meeting. A copy of one letter of objection to CDC was received by the PC. In order to present an informed view at the meeting the Parish Council invited senior representatives of the County Council. District Council and the Housing Association to attend. Four members of the public against the application attended the planning meeting.<br />
 <br />
 Mrs Goldsmith explained the history of the school house and how over the last decade or so unsuccessful attempts were made to utilise the house for key workers or school use due to lack of interest or prohibitive costs. Finally in 2006 the WSCC Education department declared it surplus to their needs and discussions started on the future of the house and garden. Mr Irving explained this culminated with the proposals to develop the house and garden for social housing held in perpetuity for Sidlesham associated people who have priority. If there are no high qualifying Sidlesham people, accommodation would be offered to those with less qualification.<br />
 The Chairman first asked the experts to respond to each of the points of objection listed in an anonymous flier circulated to some properties in the parish. The Chairman then invited the members of the public to make presentation or ask questions about the application with responses from the experts present:-<br />
 1. Concerned about noise nuisance for school and occupants of the social housing.<br />
 A. Mr Seaman explained that an additional cavity wall was planned between the house  and the school, insulation would be far in access of semi-detached housing and greater than the education building regulations of 55 dB insulation. Hastoe were prepared to have this as a permission condition from CDC.<br />
 2. Concern for privacy of children due to windows overlooking playground.<br />
 A. Mr Seaman explained that the current first floor window would be blocked, a window on the first floor would have obscure glass in a fixed shut frame, the only other windows on that side would be Velux roof lights.<br />
 3. The plans illustrated a new access provided for the residents and teachers to the front playground.<br />
 A. Yes, old entrance near to corner closed therefore safer and agreed so with WSCC Highways.<br />
 4. Did the development encroach on the school boundary?<br />
 A. No, it was contained within the house and garden area of the house belonging to the County Council.<br />
 5. At the eastern end of the plot there was a piece of land with a drainage ditch.<br />
 A. The corner near the large tree belongs to WSCC Highways. Mrs Goldsmith agreed to discuss with Highways the possibility of inclusion in the curtilage. Mr Seaman agreed also to raise this as it could potentially be included in the plot and work specified to maintain the drainage.<br />
 <br />
 The Chairman then asked for discussion and the views from the Parish Councillors.<br />
• The school store adjacent to the house is ugly, could it be made better?<br />
 Mr Seaman agreed it could but to date no proposals had been made to consider it.<br />
• The plans were described as very innovative and that it was an opportunity to give five local families a home.<br />
• Additionally the plans were described as exceeding expectation and the Council was pleased that solar heating was proposed.<br />
• One minor but important point was raised that the Victorian coping bricks on the wall should be retained on the rebuilt better visibility wall.<br />
 <br />
 The Chairman then asked the Parish Councillors to vote for or against the application. The voting result was nine for and none against. A response to be made to CDC of no objection but with a request for the sound insulation to exceed the education standard of 55dB and to ask for the retention of the coping stones.</p>
<p>5.2 SYSI/09/03084/FUL. Grass Verge Opposite Ferry Farm House Chichester Road Selsey. A shared surface path for walkers and cyclists from Pagham Harbour to Selsey Manor Road Roundabout.  O.S. Grid Ref. 485642/96197 Parish Council conclusion no objection.</p>
<p> 5.3 SI/10/01663/COU. 7A Cow Lane. Retrospective application for the stationing and storing of 13 mobile homes within the horticultural holding for horticultural workers employed on the holding.<br />
 O.S. Grid Ref. 484843/973805. Parish Council conclusion no objection but to request a right of residence restriction and that accommodation be limited to the benefit of the current business.</p>
<p>5.4 SI/10/01835/REM. The Fairways, Brimfast Lane. Replacement of existing dwelling with 1 no. 4 bedroomed cottage.<br />
 O.S. Grid Ref. 485544/100063 The Parish Council concluded that the site would benefit greatly from development but would best be served by the submission of a new full application. Reasons being;-<br />
• There is doubt over the timely fulfilment of conditions of site clearance stipulated for the outline permission.<br />
• The dimensions of the proposed house are not as the outline permission.<br />
• The area of the site given on the application is incorrect. <br />
• The PC is informed that the access path does not form part of The Fairways curtilage but is owned by the neighbouring property, with a right of access to The Fairways.  </p>
<p>5.5       SI/10/01768/FUL. Mr And Mrs Parker Longacre, Highleigh Road. Replacement dwelling (Single).<br />

<p>6.3 SI/10/00134/COU. Hillfield Car Sales. Unit 1 The Forge Lockgate Road. Use of premises for vehicle preparation prior to sale comprising mechanical repairs and servicing and valeting (no body work or paint spraying of vehicles). REFUSE<br />
 “CDC considers the premises suitable for B1 use (but) considered the B2 use proposed would be harmful to the amenity of neighbouring and nearby residents and the rural character of the area due to disturbance from noise and other emissions, general activity, and consolidation of existing on-road parking that occurs in Lockgate Road&#8230;.would be contrary to policies CC6 and NRM10 of the South East Plan 2009 &#8211; 2026 and policies BE11 and RE14 of the Chichester District Local Plan First Review 1999.”<br />
 It was reported to the Parish Council that a ‘Mattress Recycling’ organisation had set up in the  buildings. The Clerk was asked to ascertain whether all licenses etc for waste disposal and environmental health were in place.</p>

<p>5. New Applications.<br />
5.1 SI/10/00690/DOM. Land South East Of Little Acre Keynor Lane, Sidlesham. To erect a 2m closeboard fence along the front of property. The fence is 4m from the road with a 1m grass  verge, a 1.5m ditch  and a 1.5m deep hedge row.  More hedging to be planted to thicken up the hedge.<br />
OBJECT. The Parish Council did not object to the retrospective erection of the fence but did object to the hedge. It was considered the species planted were inappropriate. As Keynor Lane is a country road  Council  would prefer to see the current hedge removed and re-planted to benefit the rural environment  and lane scene.  The plants to be indigenous hedgerow species.<br />
5.2 SI/10/00793/FUL.  Land South Of Units A To D Jury Lane Sidlesham Common West Sussex Erection 19m x 6.7m block work building. For the manufacture of small water craft and repairs of GRP  boats.<br />
 No Objection. (Conditions requested). The Parish Council did not object to the application to erect the building but considered the facilities as given were inadequate. The response to request of CDC Planning  that provision be stipulated for the correct storage of chemicals and that all waste from the  manufacturing process (including any chemical waste) should be contained and disposed of correctly.  Also that adequate measures should be imposed to restrict fumes.<br />
The Parish  Council considered also that as the application did not provide for washing and toilet facilities for the staff any permission should make such facilities conditions of approval.</p>

<p>5.2  The Clerk asked leave to bring to the attention of the Committee as Correspondence the following notice of an application received earlier in the day (17 March).</p>
<p>SI/10/01006/TPA Chalk Lane Road Management Committee, Chalk Lane.<br />
Various tree works including reducing, removing branches/stems/stubs, epicormic growth, crown lifting up to 5m (above ground level), reduce sectors (mainly over road up to 4m) cut back tips, cut back from power lines and remove damaged branches on 18 no. Poplar trees (T1 &#8211; T4, T6 &#8211; T11, T13, T14, T21, T24, T25, T40, T48 and T49) and 31 no. Poplar trees and 1 no. Hawthorn tree within Groups &#8211; G1 (x 6), G2 (x 3), G3 (x 3), G4 (x 1), G5 (x 3), G6 (x 5), G7 (x 4), G8 (x 1), G9 (x 5) and G10 (x 1) (Hawthorn tree).  Fell 4 no. Poplar trees (T5, T12, T15 and T16) and 8 no. Poplar trees within Groups &#8211; G3 (x 3), G4 (x 1), G5 (x 3) and G6 (x 1).  All 62 no. trees are subject to SI/86/00938/TPO. O.S. Grid Ref. 485013/96953<br />
It was agreed by the Committee that due to the specialist nature of the application and the complexity of the issue, the Parish Council should defer consideration of the application to the District Council Tree Officer. With provisos as detailed previously in similar circumstances.<br />
“That the Council is anxious to preserve the picturesque avenue of Poplars in Chalk Lane as they form a unique landscape feature within the parish.  The Council requests that CDC officers are vigilant in their interpretation of the rules relating to TPOs and that felling should only be permitted where deemed absolutely essential and that severe pruning be kept to the minimum necessary to ensure public safety.”  <br />
The Clerk to publish this conclusion on the notice boards.</p>

7.2 Action: The Clerk to enquire in light of the Inspectors conclusions for 7.1; and at the end of other temporary permission periods for accommodation current in the parish, what action will CDC be taking.<br />

7.4  CDC Enforcement department informed the Parish Council that the land user of the field adjacent to Little Acre, Keynor Lane had been instructed that a planning application / permission was required.</p>

2. Minutes of the planning meeting held 3 February 2010. Before asking for approval Mr Field requested discussion of 5.1 (SI/10/00086/FUL. 86 Fletchers Lane) as the agent for the applicants considered the PC response to CDC was more negative than he observed as the conclusion at the meeting; the response containing having contained all of the items raised rather than the final statement. A message from Mrs Pound stated she considered not all of the stated objections were discussed. Mrs Pound’s opinion was refuted by the Councillors present. Mr Harland proposed that the minutes should be signed as a correct record, Mrs Ranjbar seconded and all Councillors agreed.  </p>

5.2       SI/10/00013/DOM 24 Chalk Lane, Sidlesham. First floor front and rear extensions.<br />
PC conclusion – no objection.<br />
5.3       SI/10/00202/FUL. Three Oaks Nursery, Selsey Road. Siting of mobile home for agricultural worker for temporary period of three years.<br />
PC conclusion – no objection.<br />
5.4      SI/10/00227/ELD. Green Lane Piggeries, Ham Road. Use of land for stationing of caravan for the purposes of residential accommodation.<br />
PC conclusion – object.<br />
The Council considered that the stationing of the caravan and the residential use should not be decided under the ‘4 year rule’ as such use had been clandestine and deliberately in breach of planning communications from Chichester District Council. <br />
Although there were declarations of residential use; the similarly worded letters were from the applicant’s immediate acquaintances with close knowledge of the site. To the general parish such use was hidden and withheld from the District Council. In 2007 application was made to alter another of the buildings into a residence. On the site map submitted for that application SI/07/05409/FUL the position of a caravan was not drawn although it was now stated to have been present and subsequently replaced with another.<br />
The Parish Council objected to use of the land for residential purposes as it is not in a Settlement Policy Area, also it is in a position considered by the Environment Agency to be at risk of flooding. The accommodation was not required for agricultural purposes.<br />
5.5      SI/10/00229/ELD. Green Lane Piggeries, Ham Road. Use of building as a dwelling house, or for residential purposes<br />
PC conclusion – object<br />

By a vote of 5 against, 1 for and 1 abstention the Councillors objected to the construction for the following reasons: -<br />
• The area is particularly sensitive immediately adjacent to Sidlesham Parish Church.<br />
• The pool site is too close to the boundary and south door of the church. Noise and activities, normal for a swimming pool, could be intrusive and detrimental to the use of the church and burial ground. <br />
The Councillors considered that should permission be granted screening and acoustic barriers should be conditions stipulated by CDC Planning Department.</p>

3.1  (9.1) Enborne Business Park Selsey Road. (Formerly Salliota).  Yellow lights reported to be illuminated all night causing considerable light pollution, contrary to the planning permission for the site.  Clerk informed CDC Enforcement Section; the item was logged and will be investigated.<br />
3.2 (9.2) The footpath across Slep Field is not yet restored due to the recent heavy snowfalls and rain.</p>

 Use of property as a self contained dwellinghouse.<br />
 Conclusions. Prior to the receipt of the application papers none of the Parish Councillors was aware of the existence of this unauthorised development in the grounds of 3 Gorse Terrace. Therefore no  response could be made on the history of development or habitation of the building.</p>
<p> The Parish Councillors requested that should a certificate of ELD be granted by CDC there should be a condition that “Berryrose Garden Cottage” be tied to 3 Gorse Terrace, never to be sold as an  independent habitation, The reasoning for this request to prevent such hidden unauthorised buildings  forming precedents for similar clandestine procedures in areas considered unsuitable for  development.</p>

<p> 5.1 SI/10/00086/FUL. 86 Fletchers Lane. Demolition of existing house and erection of replacement dwelling with associated garage and boundary wall.<br />
Conclusion- objection by a vote of 7 to 1<br />
The Council objected to:-<br />
• The stark appearance of the structure, out of keeping in a road dominated by the ex- Land Settlement houses. The dominating features of a sombre rendered wall and a zinc roof would not fit or blend with the Fletchers Lane street scene. The design is not sympathetic to a rural setting.<br />
• Curtilage delineated by a rendered wall rather than hedges.<br />
Positive points:-<br />
• Exciting concept to propose a modern design as a replacement house.<br />
• Position back from the roadway to give space.<br />
• The many energy saving initiatives.<br />
• Concept of a house suitable for multi-generation family occupation.<br />
5.2 SI/10/00134/COU.  The Forge, Lockgate Road. Use of premises for vehicle preparation prior to sale comprising mechanical repairs and servicing and valeting (no body work or spraying of vehicles).<br />
Conclusion- No Objection (but with requests)<br />
No objection to the change of use but clarification requested from CDC whether all three units of the building were to become B1 classified use or only the one unit as at present?<br />
Also if the application is permitted certain conditions requested to be imposed.<br />
• All vehicles associated with the company (including employees’ and visitors’ vehicles) to be parked off the road on ‘The Forge’ premises.<br />
• Access not suitable for very large vehicles.<br />
• Hours of business to be in keeping with the location<br />

7.1 SI/09/02498/COU; DLCG Ref No: APP/L3815/A/09/2115242/NWF. Change of appeal date. Appeal against the District Council&#8217;s refusal of planning permission for Permanent planning permission for a mobile home. Site Location:  Greenacres Nursery, Keynor Lane, Sidlesham. the Hearing for this case to be held at 10.00 am on Tuesday 16th February 2010 at WSCC, County Hall, West Street, Chichester.  The Public may attend and at the Inspector’s discretion give their views.<br />

8 AOB<br />
8.1 An entrance was under construction from a field on the south side of Keynor Lane between the junctions with Chalk Lane and Cow Lane. The PC received a request to know if this was permitted. On investigation it appeared to be made from on an existing gateway. The Clerk to seek confirmation.</p>
<p>8.2 The flood water issuing from a cover on the B2145 opposite the petrol station was suspected to be associated with rain water drainage and possibly sewerage. The Clerk to seek further information.<br />

<p>2. Minutes of the planning meeting held 18 November 2009. Mrs Smart proposed, Mr Bond  seconded  and all agreed that the minutes should be signed as a true record.</p>
<p>3. Matters arising from the above minutes.<br />
3.1 (9.1) Metal fencing at Redgate Barn. Observation of the fencing indicates that it is more than the  required distance from the highway and reasonably screened by vegetative growth.<br />
3.2 (9.2) Mr Field spoke to the farmer who stated that the footpath across Slep Field would be restored  immediately.<br />

4. Declarations by Councillors of personal interests. None</p>
<p>5. New Applications for discussion.<br />
5.1 SI/09/06897/DOM. Holmby, Mill Lane. Proposed single storey rear extension.<br />
 PC decision ‘No Objection’.</p>
<p>5.2 SI/09/03600/FUL. Chichester Canvas, Chichester Road. 2.1 metre high green mesh fencing to front of  premises incorporating 2 gates and hedge planting to  Chichester Road. PC decision ‘No Objection’.</p>
<p>5.3 SI/09/03663/TCA. Oakdene, Mill Lane. Crown reduce by 20% 1 no. Maple tree (2) and 1 no. Apple tree  (4). Fell 2 no. Holly trees (3 and 5) and 1 no. Rowan tree (7). Notification of intention to crown reduce  by 30% 1 no. Oak tree (1) and 1 no. Ash tree (6).  PC decision ‘No Objection’.         </p>
<p>5.4 SI/09/03687/DOM. Boxham Lane Cottage 1 Boxham Lane.  Replacement garage (Barn style).<br />
 PC decision ‘No Objection’.</p>
<p>5.5 SI/09/03705/PLD Church House, Church Farm Lane. Outdoor swimming pool.<br />
 PC decision ‘Object’ to PLD, request full planning application be requested by CDC.<br />
 Reasons for objection:-<br />
• The property is in the Sidlesham Church Conservation Area.<br />
• The area is particularly sensitive immediately adjacent to Sidlesham Parish Church.<br />
• The proposed pool site is too close to the boundary and approximately only 15 metres away from the south door of the church. Noise and activities, normal for a swimming pool, could be intrusive and inappropriate to the environment and setting of the Grade 1 listed church building and burial ground.<br />
• The curtilage boundary is indistinct.<br />
• Screening and sound barriers should be stipulated by CDC Planning Department and be part of any permission.<br />
• In conservation areas, pools are stated to be considered together with outbuildings. The area of such in this curtilage (garage, bothy and pool) at distance from the house appears from the sketch drawings submitted, to exceed the 10 square metres maximum by a considerable amount.</p>
<p>5.6 SI/09/02380/PLD Littleacre, Keynor Lane. Proposed use for conservatory to utility block.<br />
 PC decision ‘Object’. Reason:- The utility block was permitted (on appeal) for washing purposes only.  The addition of a conservatory to it would convert the block into living accommodation, contrary to the  permitted use.</p>
<p>6 Planning appeal<br />
6.1 SI/09/02498/COU Greenacres Nursery, Keynor Lane. Appeal against CDC decision to not grant  permanent permission for a mobile home. The Parish Council decided the Clerk should write to the  Planning Inspectorate objecting to the appeal, expressing support for the District Council decision and  stating that the PC view is still as stated in the response of 20 August; that temporary planning  permission for a mobile home is more suitable for the situation.</p>
<p>7 CDC Decisions since last PC planning meeting.<br />
 7.1  SI/09/03292/FUL. Bramleys, Chalk Lane. Change of use from horticultural nursery to land for the  keeping of horses together with the erection of stables, feed store, tack room and wash room.  All uses  to be hobby uses and not commercial. PERMIT</p>
<p>7.2 SI/09/03443/FUL. Enborne Properties Ltd, Enborne Business Park Selsey Road. Variation of condition  no. 5 on planning permission SI/05/01644/FUL to enlarge kitchen/canteen and change of use to provide  outdoor seating area. PERMIT</p>
<p>7.3 SI/09/03476/FUL. Enborne Properties Ltd. Block B Enborne Business Park, Selsey Road.<br />
 Work bay extension to existing MOT station. PERMIT  </p>
<p>8 Planning Correspondence None</p>
<p>9 AOB.<br />
9.1 Enborne Business Park Selsey Road. (Formerly Salliota). Yellow lights were reported to be illuminated  all night causing considerable light pollution, contrary to the planning permission for the site. Clerk to  inform CDC Enforcement Section.<br />

 (9) The burned out Tyre Clinic site. The Enforcement Department CDC and the Environment Agency are starting Actions as the piles of tyres and the building are considered a hazard. In addition it is  understood the owner is considering applying to develop the site. This will not delay the actions.</p>

<p>7 School House development consultation. This item duplicated the bi-monthly agenda therefore carried forward to that meeting.</p>

9.1 Metal fencing at Redgate Barn. Item raise what screening and distance from the verge was planned. Item carried forward, Clerk to make enquiries before next planning meeting.<br />
9.2 The footpath across Slep Field was not restored some weeks after cultivation. The farmer to be approached by Mr Field.</p>
