MINUTES of Planning Committee Meeting 18th May 2011 in The Parish Church of St Mary our Lady

Minutes of Planning Committee in the Parish Church, Sidlesham at 7:20pm

Present: Mr A Harland (Acting Chairman), Mr P Bedford, Mrs E Smart, Mrs D Pound, Mrs C Hall and Mrs P Tull. 
Clerk (Mrs T MacIntyre) and 5 members of the public 

1. Apology for absence.  Mrs C Ranjbar

2. Minutes of the planning meeting held 20th April 2011 to be signed as a true record.
Mrs Pound proposed and Mrs Smart seconded that the minutes be signed. All Councillors agreed.

3. Matters arising from the above minutes.
3.1       3 Chalder Cottages, Chalder Lane.  Mrs Tull has raised the problem of the campervans being stored on the property with the Enforcement Officer at Chichester District Council.  This has been classified as ‘low priority’ but will be investigated within the next two weeks.
     
4. Declarations by Councillors of personal interests.  Mr Harland declared a possible interest in item 6.1 concerning an extension to Rose Cottage.  The owner of the cottage is a partner in the firm which has carried out building work for Mr Harland and to whose partner he sold his previous house.  However, Mr Harland did not consider that these facts constituted an interest in this application. The other councillors agreed with that statement.

No Objection.    Mr Bedford raised the concern that many of the land settlement buildings, such as Rose Farm, have been extended and are now large buildings.  While they are within the planning rules, Councillors should be aware of the scale of these extensions.  The buildings are behind hedges at present, but Mr Bedford felt that any extensions should be set back as much as possible in order to break the line of the buildings fronting on to the road.

The Council had no objection in principle.  However, the Council raised five caveats to their consent to the application:
.    The Council would object to the stacking of one container on top of another.
.    The Council would also like to stipulate that the containers should not contain hazardous materials.
.     Would the area used for storage be increased and by how much.
.     Is there sufficient parking space for people to access the containers.
.     Councillors also raised the matter of the old cars stored on the land.  Are these cars waiting to be repaired or are they to be taken to the scrap yard, in which case they should be removed.

Minutes of Planning Committee Meeting 20th April 2011

Present: Mr C Field (Chairman), Mr A Harland, Mrs C Ranjbar, Mrs E Smart, Mrs P Tull, Mrs D Kennedy   Mrs D Pound and Mr A Malir.

2. Minutes of the planning meeting held 16th March 2011 to be signed as a true record.
Mrs Smart proposed and Mr Harland seconded that the minutes be signed. All Councillors agreed.

3. Matters arising from the above minutes.
3.1        Windward Nursery, Chalk Lane.  The Clerk had received a letter from the Senior Planning Officer at CDC in response to Sidlesham Parish Council’s objection to this application.  SPC’s objection was on the basis of a lack of commercial evidence supporting this as a viable business in need of permanent residential accommodation.  CDC stated that they were in possession of this information but regarded it as sensitive which should not be made public.  The Clerk had replied that making this information available to the Parish Council was not ‘going public’ but necessary for them to make a meaningful judgement.  The Council was not happy with this change of policy and would like the District Councillor to follow it up after the election.     
3.2        The Shutters, Selsey Road.   Subsequent to SPC’s response to this application, further information became available that the adjacent property may have been bought by the applicants, on to which they have reputedly moved a large chalet.  This was not declared in the application.   Mrs Smart stated that the land is now fenced as one property.  This information was forwarded to Mrs Tull, District Councillor, who brought it to the attention of District Officers.  A site visit by CDC is now planned.

New single storey dwelling house in rear garden.

OBJECT.  Mr Field informed the Council that the present tenant of the property had not been informed of this application by the owner of the property.  Mr Field understood that the new building would not be available to the tenant and therefore could not be considered ancillary to the existing property but a separate rentable property.  A resident of Manhood Lane who was present at the meeting felt that there is already a danger of flooding from the water meadow and stream at the end of the gardens and if further buildings were to be built on their gardens, this could increase the risk.  The tenant of 36 Manhood Lane, who was also present at the meeting, raised concerns about gas storage and how the drains would join the main drainage system.

Mr Harland, Mr Field and Mrs Pound  attended the hearing at Chichester District Council and Mrs Tull, as District Councillor,  was on the Council.  Mr Field spoke on behalf of Sidlesham Parish Council against the application.  Speakers from Birdham and Earnley Parish Councils and a representative of the CPRE objected to the application.   Mr Field considered it likely that Madestein will appeal against the decision.

Alleged Breach: Without planning permission, change of use of part of the building to a use for internet / retail sales of motor vehicles
This Council had no objection to this application when first presented to the Planning Committee.  Mrs Tull will write to CDC in support of this use for the building.
 
9.   Items of Urgent public importance or information relating to planning matters for referral to
the next meeting when a decision is required. 
9.1     Chalder Lane.  Mrs Pound brought to the attention of the Council the matter of the campervans on part of farm land on Chalder Lane.   The owner of one of the three new houses in Chalder  Lane had rented the land where he kept 6 campervans and had created a business renting them out.  Mrs Pound’s opinion was that on this scale the business was not obtrusive.  However, in the last few months, this has increased to 12 landcruisers and a chalet which is used as a toilet block.  This has increased the traffic in Chalder Lane considerably.  As there has been no change of use application for the land, Mrs Pound queried whether this diversity of farmland was acceptable.   Mrs Tull will follow this up with CDC to establish whether an application for Change of Use is required.
9.2     The Tyre Clinic.  Mrs Smart raised the matter of the enforcement notice on The Tyre Clinic and was informed that work had begun to demolish the building.
