Minutes of Planning Committee Meeting Wednesday 20th September 2017 in the Church Hall, Church Farm Lane, Sidlesham at 7.00 pm
Members of the Council and the public were informed that the meeting will be recorded.

Present:  Mr P Bedford (Chairman), Mrs C Ranjbar, Dr F Lewis, Mr M Mellodey, Mrs C Hall, Mrs M Monnington,  2 members of the public, Cllr P Montyn (WSCC) and the Clerk, Mrs T MacIntyre.

2.      Minutes of Planning Committee Meeting held 19th July 2017 to be signed as a correct record. Mrs Hall proposed and Mrs Monnington seconded the proposal.  3 agreed with 3 abstentions.
3.    Declarations by Councillors of personal interests in items on this agenda. None
4.    Matters arising from the above minutes not dealt with in separate items below.
4.1    Mrs Hall raised a house being built on the Ham Road.  An Enforcement Order has been issued but construction work appears to be continuing.  The Clerk was asked to write to CDC Enforcement.
5.    Confirmation of Application Discussed on 19th July 2017
5.1    SI/17/01972/DOM - Barn Cottage Highleigh Road Sidlesham Chichester
Loft conversion including rear dormer.
(The PC had no objection to this loft conversion.  However, it was aware that planning conditions were imposed on an earlier planning application in 1997.  The PC asked what those conditions were, whether they are still enforceable and have they been complied with in this application.)  Application withdrawn.
6.    Confirmation of Applications decided by email
6.1    SI/17/02165/TCA - Harbour House Mill Lane Sidlesham Chichester
Notification of intention to fell 1 no. Plum tree (Prunus Domestica) and plant a replacement in different location.
The PC had no objection to this application.  However, CDC may wish to seek assurance that the applicant has permission from the owner of the tree.  The gap between Harbour House and Dolphin Cottage is designated an "an important view" within the Conservation Area.  Should the tree be replaced, this view should be retained.  All agreed.
6.2    SI/17/02212/DOM – Meadowview, Jury Lane Sidlesham Common PO20 7PX
Demolish existing garage, store and conservatory.  Erection of rear extension, side extension and front extension. Raise height of roof. Front and rear dormers.
The PC had no objection to this application but expressed concern about foul and service water drainage from this substantially enlarged property.   All agreed.
6.3    SI/17/02199/TCA - Faiths Cottage, Church Lane, PO20 7RH
Crown reduction by 20%, reduce height by 2m and natural limbs back by 1.5m - 1no. Eucalyptus tree.  No objection.  Unanimous decision.
6.4    Greenacres, Keynor Lane - CDC has upheld the conditions as originally proposed and the applicant has now accepted the position. Our objection to the changes the applicant had suggested do not therefore now apply and the PC will withdraw its objection. (The application had applied for changes to "opening hours" and periods when the building could be occupied (condition 17). The opening hours remain as previously set out but the concession is now that the buildings can be occupied outside these hours for activities that would not cause any disturbance.  Use is now confirmed as B1, B8 and D1, defined as craft workshops (condition 20).  Unanimous decision.
7.    New Planning Applications for Discussion
7.1    SI/17/02324/DOM - Dolphin Cottage  Mill Lane Sidlesham PO20 7LU
Two storey rear extension to replace a single storey extension and UPVC conservatory plus internal modifications. Minor amendment to previously approved application SI/17/00476/DOM.
O.S. Grid Ref. 485827/97360
The PC welcomed the fact that the wall has been moved back from the boundary but continues to regard this as overdevelopment of the site and retains its concerns regarding the distance of the building from the boundary.  In addition, windows on that boundary should be vent windows and unable to overlook Harbour House property.  All agreed
7.2    SI/17/02387/FUL - Willowdene Fletchers Lane Sidlesham PO20 7QG
Change of use of an existing agricultural building to 1 no. dwelling house and erection of pitched roofs over flat roofed parts of building (Use Class C3). An alternative to permission SI/15/00489/COUPMB.  O.S. Grid Ref. 484724/99476.
The PC maintains its view that this building is inappropriate for conversion, hence the scale of the alterations proposed.  However, the PC has no objection to changes to the building.  Unanimous decision.
7.3    SI/17/02601/FUL - The Cottage Chichester Road Sidlesham Common Chichester
Domestic outbuilding and driveway and change of use of land to garden land for use in conjunction with The Cottage.  O.S. Grid Ref. 485069/99863
No objection.  Unanimous decision.

8.10   SI/17/00942/FUL - Greenacres Nursery  Keynor Lane Sidlesham PO20 7NG
Variation of condition 17 (hours of use) and condition 20 (restrictive use) from planning permission SI/16/02036/FUL (4 no. Class B1/B8/craft workshops (D1) units and 1 no. Class C3 holiday let unit).  PERMIT WITH S106
9.       Planning Correspondence and other planning matters.
9.1     LSA Agricultural Building Conversions.
Mr Bedford, Mr Mellodey and Mr Charter (Earnley PC) met and exchanged correspondence and detailed information.  They will produce a paper to go to CDC to propose restrictions on these conversions.  Foul drainage is a significant issue.  The lack of any CIL contribution results in a significant number of new residential buildings in the area with no return for the community.  Government has recently looked to change the legislation but this may increase both the number of units and the floor area.
9.2     Appeal:  Land to the North Of Sunnybrook, Highleigh Road, Sidlesham
New dwelling house, garden, greenhouse and ancillary landscaping.
The Clerk was asked to write to the Planning Inspectorate and reiterate the PC’s earlier concerns.
9.3     Jalna, Jury Lane – letter from CDC Planning Officer.
The PC will reply to CDC to reiterate its normal policy that caravans are regarded a temporary structures and have been given permission for 3 years only.  There is no precedent for a permanent dwelling or footprint for a building on the site.  In the absence of any supporting evidence, the committee considered that no horticultural or for that matter other valid use had been established and that no succession to a permanent building had been established.
9.4    SI/17/02510/FUL - Red Barn Selsey Road Sidlesham Chichester
New external cladding, new windows and doors, replacement profiled metal sheeting on roof with Kingspan insulated curved roof panels, and insertion of roof lights in roof. External changes to building permitted under Class P Prior Approval for Change of Use from Class B8 (Storage) to Class C3 (Dwelling house) under SI/17/00882/PA3P. O.S. Grid Ref. 485569/97314
The PC has serious concerns regarding foul drainage in that area and, in addition, problems related to access to the B2145;   one more dwelling will exacerbate those problems.  The PC expressed concern that land to the front of the building could have the potential for the building to double in size.  The building will be highly visible from the public highway and suggested that screening be planted on the highway boundary.  The PC has no objection to changes to the building.  All agreed.  This decision will be confirmed at the October meeting.
9.5    SI/17/02639/ELD - 36 Chalk Lane Sidlesham PO20 7LW
Use of land and buildings for B1(c) purposes. O.S. Grid Ref. 485121/97682
The PC has no concerns with the ELD but would restrict its use to B1(c ). and would ask CDC to consider removing the permitted development right to change the use from light industrial to residential as the council would not wish to see another residence on this site.  This decision will be confirmed at the October meeting.
