Minutes of Planning Committee Meeting Wednesday, 20th March 2019 in the Church Hall, Church Farm Lane, Sidlesham at 6.00 pm

Members of the Council and the public were informed that the meeting will be recorded.

Present:  Mr P Bedford (Chairman), Mr A Harland, Mrs C Ranjbar, Dr F Lewis, Mr C Hall, Mr R Ryder and Mr M Mellodey, Cllr P Montyn (WSCC), Cllr P Tull (CDC) and the Clerk, Mrs T MacIntyre.

1.    Apologies for absence:  Mrs M Monnington
2.      Minutes of Planning Committee Meeting held 20th February 2019 to be signed as a correct record.  Mr Harland proposed and Mrs Hall seconded that the Minutes be signed.  5 Councillors agreed with 2 abstentions.
3.    Declarations by Councillors of personal interests in items on this agenda.
3.1    Mrs Ranjbar declared an interest in Item 5.1 (Willowdene, Fletchers Lane, Sidlesham).  She will abstain from the vote.
4.    Matters arising from the above minutes not dealt with in separate items below.
4.1    SI/18/03429/ELD The Fairways, Brimfast Lane.  (Item 6.6 16th January 2019)
Mr Bedford raised the conversion of buildings on the above property.  The PC had requested that CDC investigate the S106 Agreement which committed the owner to demolish existing storage and outbuildings on the site as a condition of building a new residential property. This should have been enforced and no ELD established.  The PC has not had a response from CDC.
5.    New Planning Application for Discussion
5.1    SI/19/00599/PA3Q – Willowdene Fletchers Lane Sidlesham Chichester
Change of use from agricultural building to 3 no. dwellings (C3 Use Class).
The PC objects to this Application.  It has consistently objected to the conversion of glasshouses which it considers unsuitable for conversion.  Cllr Tull was asked to red card the Application.  6 agreed with 1 abstention.
5.2    SI/19/00574/DOM – 43 Manhood Lane Sidlesham PO20 7LT
Erection of single storey rear extension with alterations and additions to fenestration.
No objection.  6 agreed with 1 abstention.
5.3    SI/19/00552/TPA – Church Gate Cottage, Church Lane Sidlesham PO20 7RH
Crown reduce by 2-3m (all round) on 2 no. Lime trees (T1 & T2, shown on the plan the other way around) subject to SI/12/00099/TPO.
The PC has no objection to this application.  It leaves the degree of tree work to the discretion of the District Tree Officer.
5.4    SI/19/00627/DOM – The Maltings Mill Lane Sidlesham Chichester
Single storey rear extension with associated roof works including 1 no. roof lantern as approved under SI/18/01986/DOM. Vary conditions 2 and 3 relating to door position and removal of mansard roof.
No objection.  Unanimous decision.
5.5    SI/19/00084/TPA – 35 Chalk Lane Sidlesham Chichester West Sussex
Fell 1 no. Black Poplar tree (T5). Reduce crown widths/spreads to 5m and heights down to 15m, sever ivy and remove deadwood on 2 no. Black Poplar trees (T3 and T4) and 1 no. Black Poplar tree (quoted as T1 – northern tree, within Group, G3). All 4 no. trees are subject to SI/86/00938/TPO.
The PC has no objection to this Application subject to the approval of the District Tree Officer.
6.    Planning Decisions
6.1    SI/18/00768/FUL – 83 Fletchers Lane Sidlesham PO20 7QGE
Erection of chicken shed.   PERMIT.
6.2       SI/18/02056/DOM – Swallow Nursery, Selsey Road Sidlesham PO20 7QX
Two storey side extension and a single storey extension to the rear.  PERMIT.
6.3       SI/18/02692/PLD – 62 Street End Lane Sidlesham PO20 7RG
All or any development as permitted by Schedule 2 Part 1 Development within the curtilage of a dwelling house of The Town and Country Planning (General Permitted Development) (England) Order 2015 (as amended now or in the future).   REFUSE.
6.4       SI/18/02847/FUL – South Barn, Willowdene Fletchers Lane Sidlesham Chichester PO20 7QG
Erection of 1 no. 2 bed dwelling as alternative to planning permission SI/17/02970/FUL for Change of Use of an existing agricultural building to 1 no. dwellinghouse and erection of pitched roof over flat roofed building (Use Class C3).  PERMIT WITH S106.
6.5       SI/18/02848/FUL – North Barn, Willowdene Fletchers Lane Sidlesham Chichester PO20 7QG
Erection of 1 no.  2 bed dwelling – alternative to planning permission SI/17/02387/FUL for change of use from agriculture to 1 no. 2   bed dwelling and pitched roofs over flat roofed parts of building.
PERMIT WITH S106.
6.6    SI/18/03071/ELD – Oakleigh House, Highleigh Road Sidlesham PO20 7NR
Use of Oakleigh House as an independent C3 dwellinghouse – in breach of condition 3 of outline permission SI/7/78.   PERMIT.
6.7       SI/18/03429/ELD – The Fairways, Brimfast Lane Sidlesham PO20 7PZ
Existing lawful development certificate for use as commercial storage (B8).   PERMIT.
6.8       SI/18/02490/FUL – Woodlands Keynor Lane Sidlesham Chichester West Sussex PO20 7NG
Use of part of the site for the stationing of 3 caravans for use as horticultural worker accommodation and their storage off season.   PERMIT.
7.           Planning Correspondence and other planning matters.
7.1    SI/19/00706/PLD – Mill House 8 Mill Lane Sidlesham PO20 7LU
Single storey rear extension under permitted development.
No objection.  This decision will be confirmed at the April 2019 Planning Committee Meeting.
7.2    SI/19/00757/PA3P – The Fairways Brimfast Lane Sidlesham Common Chichester
Notification for Prior Approval for a Change Of Use from Storage or Distribution Buildings (Class B8) and any land within its curtilage to dwellinghouses (Class C3).
The PC was unable to consider the Application until the legal position regarding the S106 Agreement entered into concerning the demolition of existing buildings on the property has been resolved.
This decision will be confirmed at the April 2019 Planning Committee Meeting.
7.3    Appeal:   17/02640/FUL – Land At Junction Of Keynor Lane And Selsey Road, Sidlesham.
Change of use of land from agricultural land for stationing of caravans for residential purposed by 3 no. gypsy-traveller families, with associated utility building, hard standing, widened gateway, landscaping and access.
The PC maintains its objection to this Planning Application and will submit a statement to the Planning Inspectorate.
7.4    Appeal:  18/01173/FUL – Land at Junction Of Keynor Lane and Selsey Road
Change of use of land from agricultural land for stationing of caravans for residential purposes by 3 gypsy-traveller families with facilitating development (utility buildings, hard standing, widened gateway, septic tank and landscaping).
The PC maintains its objection to the Planning Application and will submit a statement to the Planning Inspectorate.
7.5    Appeal:  18/01353/PA3Q -  Butskiln, Street End Road, Sidlesham, Chichester
Notification for Prior Approval for a Proposed Change of Use of Agricultural Building to 2 no. dwellinghouses (Class C3) and for associated development.
The PC maintains its view that glasshouses are unsuitable for conversion and will submit a statement to the Planning Inspectorate.
7.6    Red Barn, Selsey Road.  The PC has been informed that the owner of Red Barn has erected a lodge in the statutorily protected Sidlesham Copse Ancient Woodland.  CDC Enforcement has been informed and will investigate.
7.7    A statement from Earnley PC on agricultural conversions in Earnley to Mr A Frost, CDC Director of Planning & Environment had been circulated.  Mr Mellodey and Mr Bedford will draft a statement from Sidlesham PC on agricultural/horticultural conversions, together with a record of conversions in Sidlesham to be sent to Mr Frost.
